I tenaciously negotiate with the probation department, the District Attorney's Office and/or the Judge to keep you out of jail, or to release you if you are already there. I talk to the Judge and the prosecutor as soon as possible in order to negotiate my client's freedom. If my client does go to jail, he has a right to a speedy violation hearing. I ensure that the violation hearing gets scheduled as soon as possible so my client does not sit in jail needlessly. Instead of sitting back and waiting for the hearing to take place, I take action. I write a letter to the judge so that he or she can hear my side of the story. If there is any restitution or fines, I encourage my client to pay them if at all possible. If there are AA meetings he was supposed to attend, I encourage him to go. Although I cannot erase the charge, most judges appreciate a proactive approach.
